The petitioner is seeking regular bail in connection with R.C. Case No. 10(S)/2016/CBI/EOW/Ranchi for the alleged offence registered under sections 120B r/w 406, 420, 409 of the I.P.C. now cognizance has been taken for the offence under sections 120-B r/w 420 and 409 of I.P.C. and under section 4, 5, 6 of Prize Chits Money Circulation (Banning) Act, 1978 and under section 67 and 68 of the Company Act, pending in the Court of learned S.D.J.M-cum-Special Judicial Magistrate, C.B.I, Dhanbad.

Learned counsel appearing for the petitioner submits that the petitioner is in judicial custody since 31.05.2023 and chargesheet has already been submitted. He submits that during trial the petitioner will not tamper with any of the evidence.

Mr. Anil Kumar, learned A.S.G.I. appearing on behalf of C.B.I opposes the prayer on the ground that innocent persons have been cheated and the petitioner was one of the director of the companies.

Considering that the petitioner is in judicial custody since31.05.2023, chargesheet has been submitted and the petitioner will not tamper with any of the evidence during trial, I am inclined to grant regular bail to the petitioner.

Accordingly, the petitioner, above named, shall be

released on regular bail, on furnishing bail bond of Rs.20,000/(Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned S.D.J.M-cum-Special Judicial Magistrate, C.B.I, Dhanbad in connection with R.C. Case No. 10(S)/2016/CBI/EOW/Ranchi.
