The petitioner is apprehending his arrest in connection with Ghaghra P.S. Case No. 81 of 2023 registered under Sections 406, 409, 420, 34 of the I.P.C. and under section 25 of the Mahatma Gandhi National Gramin Employment Guarantee Act, pending in the Court of learned S.D.J.M., Gumla.

Learned counsel for the petitioner submits that the petitioner is Rozgar Sevak of village of Bimarla Panchayat. He submits that allegations are that in place of human labour J.C.B. was being used. He submits that there is no withdrawal of money by this petitioner. He submits that co-accused has been provided anticipatory bail in A.B.A. No. 22 of 2024.

Learned counsel for the State opposes the prayer for anticipatory bail on the ground that in lace of human labour, J.C.B. was being used.

Considering that one of the co-accused has been provided anticipatory bail in A.B.A. No. 22 of 2024, I am inclined to grant anticipatory bail to the petitioner. Accordingly, the above named petitioner is directed to surrender before the learned court within three weeks from today and in the event of his surrender / arrest, the petitioner shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each, to the satisfaction of the learned S.D.J.M., Gumla, in connection with Ghaghra P.S. Case No. 81 of 2023, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure and the petitioner will not change his mobile number which is indicated in his Aadhar.
