When the matter is called out, the learned counsels for the parties are present.
The learned counsel for the petitioner submits that the allegations were made against 2 persons and the substance was recovered from the vehicle and one of the co-accused has been granted the privilege of bail, and therefore, he seeks parity, particularly in the light that trial is not making much progress.
The learned counsel for the State has vehemently opposed the prayer for bail of the petitioner and submitted that there is no parity between the accused enlarged on bail and this petitioner, as the vehicle from which the narcotics substance was recovered belongs to this petitioner.
Having heard learned counsels for the parties and in the facts and circumstances on record, I am not inclined to grant bail to the petitioner.
Accordingly, the prayer for bail of the petitioner stands rejected in connection with NDPS Case No 38 of 2023 arising out of Sonahatu (Rahe) PS Case No. 38 of 2023.
The learned trial court below is directed to expedite the trial as per law.
