Apprehending his arrest, petitioner above named has moved this Court for grant of anticipatory bail in connection with Daltonganj twon P.S. Case No.373 of 2023 registered under Sections 406, 420 & 409 of the Indian Penal Code and Section 7 of the Essential Commodity Act, pending before the learned Chief Judicial Magistrate, Daltonganj.

Heard the learned counsel appearing on behalf of the petitioner, and the learned S.P.P appearing on behalf of the State. 3. The allegations against the petitioner are that the petitioner after receipt of the paddy from the farmers did not supply the agreed quantity of rice to the FCI and the deficit quantity of supply of rice was 10445.065 quintal. It is submitted that it is a civil nature of dispute between the parties arising in the wake of violation of agreement, if any that the agreed amount of rice after processing the paddy crops have not been supplied and therefore no criminal offence is made out. It has further been submitted that the similar nature of case was also instituted against this petitioner vide Garhwa P.S. Case No. 134 of 2023 registered for the offence under Section 406, 420 & 34 of the IPC in which the petitioner being the owner of Jay Bajrang Agro Firm Pvt. Ltd., Rohtas, Bihar has been enlarged on bail by the Co-ordinate Bench of this Court vide A.B.A No.7390 of 2023 and therefore this petitioner deserves to be enlarged on bail in this case also.

On the other hand, the learned S.P.P appearing on behalf of the State opposed the contentions raised on behalf of the petitioner and submitted

that the petitioner was involved in a similar nature of case in Garhwa also and therefore he is a chronic defaulter and he does not deserve to get anticipatory bail in this case but the learned S.P.P. does not deny this fact that all the allegations are arising out of agreement and in a similar nature of case related in connection with Garhwa P.S. Case No.134 of 2023, this petitioner has got anticipatory bail.

Having heard the learned counsels for the parties, perused the record of this case.

In view of the forceful submissions advanced on behalf of the petitioner and the facts and circumstances of this case, it is found just and fair to enlarge the petitioner on bail, accordingly, the petitioner is directed to be enlarged on bail in the event of his arrest or surrender within 10 days from the date of this order and by furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand Only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Daltonganj in connection with Daltonganj twon P.S. Case No.373 of 2023, and the petitioners will co-operate in the investigation and trial and they will appear as and when required by the concerned Court failing which appropriate orders shall be passed by the concerned Court for the cancellation of bail as per the provisions of law and also subject to the conditions as laid down under Section 438(2) Cr.P.C.
