2/15.05.2023 Heard Mr. Chandan Tiwari, learned counsel for the petitioner and learned AC to S.C. II for the State.

In this writ application, the petitioner has prayed for a direction upon the respondents to grant promotion to the petitioner to the post of Plant Protection Inspector/Surveillance Inspector/Pest & Disease Reporter and consequently to the post of Junior Plant Protection Officer (JPPO)/Surveillance Officer/Assistant Director of Agriculture (Plant Protection) as according to the petitioner he fulfills all the necessary criteria for being granted promotion to the said post.

The petitioner has been appointed in the year 2000 as a Plant Protection Supervisor under the Department of Agriculture and after reorganization of the State, the petitioner was allotted Jharkhand cadre. It is the grievance of the petitioner that in spite of completing 22 years of service, he has not been given a single regular promotion.

Learned counsel for the petitioner has submitted that the last meeting of Departmental Promotion Committee was held in the year 2012 and even after expiry of almost a decade, no meeting has been held thereby depriving the petitioner from his regular promotion to the post of Plant Protection Inspector/Surveillance Inspector/Pest & Disease Reporter and thereafter the subsequent promotion as Junior Plant

Protection Officer (JPPO)/Surveillance Officer/Assistant Director of Agriculture (Plant Protection). It has further been submitted that the petitioner has represented the authorities, but the same has not been acted upon.

In view of the averments made in this writ application as also submissions advanced by the learned counsel for the parties, the matter has to be considered by the concerned respondents at the first instance.

Accordingly, this writ application is disposed of with a liberty to the petitioner to file a fresh representation stating in details his claims with respect to his promotion within a period of 3 weeks before the respondent no. 3 and if such representation is filed, the respondent no. 3 shall consider the same and dispose it of by a speaking and reasoned order within a period of four weeks thereafter.

It goes without saying that if the claim of the petitioner is found to be admissible, necessary order to that effect should be issued expeditiously by the respondent no. 3.

This writ application stands disposed of with the aforementioned directions.
