By filing this application petitioner prays for following reliefs:-

For issuance of Writ(s)/ direction(s)/ order(s) commanding upon the respondent authority for grant of MACP (Modified Assured Career Progression) Scheme and for other consequential relief which the petitioner entitled to receive.

Counsel for the petitioner submits that now the petitioner is already superannuated. Suffice it would be, if a direction is given to respondent no. 3 to consider his case as per law.

Counsel for the State submits that if the petitioner files a representation before the respondent no.3, his claim will be looked into and if it is found that he is entitled for any benefit the same will be extended to him.

Considering his submission, I direct the petitioner to file a representation before respondent no.3. If respondent no.3 will pass a reasoned order and if it is found that petitioner’s case is worth to be considered, the matter be placed before appropriate authority or Committee, who will consider the case of the petitioner and will pass an appropriate order. If the Authority/Committee holds that the petitioner is entitled to get the benefit of MACP and other benefits, the same will be extended to the petitioner and the entire process should be completed preferably within a period of twelve weeks from the date of receipt/production of copy of this order.

Accordingly, the instant writ application stands disposed of.
