The petitioner has filed an application being R.M.P.-01/22-23 in the court of Deputy Commissioner, Sahibganj under order-1 Rule-10 C.P.C. praying that he should be impleaded as party in this case. The copy of the petition is Annexure-4 to the writ petition.

The grievance of the petitioner is that Deputy Commissioner, Sahibganj without disposing of his application filed under order-1 Rule10 C.P.C. has remanded the case to the Sub-Divisional Officer, Sahibganj for initiating demarcation proceeding vide order dated 07.06.2022.

Mr. Pankaj Srivastava, learned counsel appearing on behalf of the respondent No.7 submitted that presently the matter is pending before respondent No.5 the Sub-Divisional Officer, Sahibganj and the petitioner, if so advised, may appear before the respondent No.5 and press the application under order-1 Rule-10 C.P.C.

Mr. Ashish Kr. Thakur, learned counsel appearing on behalf of the petitioner submitted that he will press this application before respondent No.5 the Sub-Divisional Officer, Sahibganj.

Considering the aforesaid facts, the petitioner is directed to appear before the respondent No.5 the Sub-Divisional Officer, Sahibganj and press the application filed under order-1 Rule-10 C.P.C. and the same shall be disposed of expeditiously by respondent No.5 in accordance with law.

With this direction, this writ petition stands disposed of.
