4/ 03.01.2023 Heard learned counsel for the petitioner and learned counsel for the respondents.

2. Petitioner, in this writ petition, has prayed for grant of ACP and MACP, which is due to the petitioner. During course of argument, counsel for the petitioner admits that the authorities have recommended grant of ACP and MACP, but actual monetary benefits have not been paid to the petitioner. He submits that the petitioner has already superannuated on 31^st January, 2022, but, his retirement benefits have also not been paid considering the recommendations for ACP and MACP. He further submits that there is discrepancy in calculation of pension also, as such, respondents be directed to consider the grievance of the petitioner and monetary benefits of ACP and MACP be released to the petitioner.

3. Counsel appearing on behalf of the State submits that recommendation has been made in favour of the petitioner to release ACP and MACP and monetary benefits will be extended very soon.

4. Considering the said submissions, I direct the petitioner to approach the Superintendent of Police, Sahibganj, by filing a detailed representation within four weeks from today. The Superintendent of Police, Sahibganj will consider the representation of the petitioner and will ensure that the monetary benefits of ACP and MACP be disbursed to the petitioner. The

post retirement benefits be also revised pursuant to the grant of ACP and MACP. It is made clear that if the petitioner disputes the calculation of pension or the post retirement benefits, it will be open to the petitioner to approach the Superintendent of Police, Sahibganj along with all the documents, which he is relying upon in support of his grievance. On receipt of such representation, within six weeks thereafter, the respondent No.3 will consider the entire grievance of the petitioner and will ensure payment of admitted retiral dues including pension with benefits of ACP and MACP. If any part of the claim of the petitioner is denied, the reasons thereof should also be communicated to the petitioner within the said period.

5. With the aforesaid observations and directions, this writ petition stands disposed of.

6. In view of disposal of the main writ petition, I.A. No. 12013 of 2022 also stands disposed of.
