In this writ application the petitioner has challenged the order dated 28.03.2023 passed in Confiscation Case No.03 of 2013 whereby the Deputy Commissioner, Latehar has confiscated the vehicle of the petitioner.

The confiscation order has been passed in terms of the Jharkhand Minerals (Prevention of Illegal Mining, Transportation and Storage) Rules, 2017 and there is a provision of appeal and revision, viz., Rule 14 provides for an appeal and Rule 15 provides for revision. Thus, there is an alternative efficacious remedy for the petitioner which the petitioner should avail.

Considering the fact that the petitioner has got alternative efficacious statutory remedy, I am not inclined to entertain this writ application. The petitioner is directed to approach the appellate/revisional authority by filing an appropriate appeal/revision along with a petition for condoning the delay, if any, which will be considered by the Authority considering the fact that this writ petition was pending before this Court. The petitioner is also at liberty to file an interlocutory application praying for stay before the Authority, which will be considered at the earliest.

Accordingly, this writ application is disposed of.
