13/ 13.07.2023 Learned counsel for the petitioners as well as counsel for the RIMS would submit that in the meantime, both the petitioners have retired on superannuation and the matter, therefore, has become infructuous.
We, however, note that the matter has been referred to the Division Bench by the Single Judge (Ananda Sen, J.) to decide the issue of conflict between the Rules and the Regulations.

While we allow the writ petitions to be withdrawn, the issue above shall be kept open to be decided in any future case.
In that view of the matter, both these writ petitions are allowed to be withdrawn.
