06/13.03.2023 The present writ petition has been filed for issuance of direction upon the respondents to issue registration number to enable the petitioner to fill up the examination form for B.Tech Examination (first semester) to be conducted by the respondent No.5 as presently he is a student of Chaibasa Engineering College, Chaibasa and has been admitted in the said college after observing due process of counselling as well as on making payment of all requisite fees including admission fee and hostel charges etc.

It has been reported by the office that the notices issued to the respondent Nos. 3 & 4 have validly been served to them.

However, no one appears on behalf of the said respondents.

Learned counsel for the respondent No.5 submits that since the petitioner’s admission in B.Tech course has been cancelled by the respondent No.3 on 20.08.2019 as would be evident from Annexure-A to the counter affidavit filed on behalf of the respondent No.5, the present writ petition has become infructuous.

At this juncture, learned counsel for the petitioner prays for withdrawal of the present writ petition with liberty to the petitioner to claim refund of admission fee and hostel charges from the respondent No.3.

Considering the submission of learned counsel for the respondent No.5 as

well as the prayer of learned counsel for the petitioner, the present writ petition is dismissed as infructuous with the aforesaid liberty.
