It appears that vide order dated 30.08.2023, petitioner was directed to file substitution application in respect of respondent nos. 9, 10, 23, 25 & 30, who have been reported dead as per the service report of notice. The said order has not been complied with as yet by the petitioner and no interim application has been filed seeking time for filing substitution petition.
On call, nobody appears on behalf of the petitioner. However, learned counsel, Mr. Nityanand Prasad Choudhary has appeared on behalf of respondent no. 1.
It appears that the petitioner is deliberately not complied with the previous order even after lapse of three months, which indicates that petitioner has no interest in the present petition.
Accordingly, the instant writ petition is dismissed for nonprosecution.
