It was further stated in the learned court that Deo Kumar Lal died leaving behind two sons, namely Mahendra Prasad and Jitendra Prasad. Defendant Nos. 1 and 2 respectively who came in possession of the land held by their father. Like wife, on the death of Baleshwar Prasad, his three sons namely Indralal Diren lal and Upendra Lal defendant Nos. 3 to 5 respectively came in possession of the share of their father. The third brother Narain lal died leaving behind seven sons, the plaintiffss and three more who were not joined as plaintiffs. It was further stated that defendants sold their share of land measuring 2 bighas, 5 kathas 01 dhur to Anwar Hussain, Mutabali of the Muslim burial committee of Sahibganj town by virtue of the registered sale deed dated 10.07.1974 for Rs. 2,000/-, which was paid to the defendant first party and possession of the disputed land was delivered to the said committee. The plaintiffs had no right to raise objection regarding obtaining of permission from the Deputy Commissioner concerned pertaining to the said transaction.
