After some argument learned counsel for the appellants has submitted by seeking leave of this Court to withdraw this appeal since the instant intraCourt appeal is not maintainable reason being that the order passed in Probate (Title) Suit No.01 of 2010 by the learned District Judge-II, Ramgarh has been assailed in this intra-Court appeal.
Considering the same, the instant appeal is dismissed as withdrawn.
However, it is left open upon the appellants to search out the remedy
to assail the order impugned before the appropriate forum.
