12/11.07.2023 Heard Mr. Mokhtar Khan, learned counsel for the appellant and Mr. Siddharth Roy, learned counsel appearing for the respondent.

This appeal is directed against the judgment dated 16.06.2017 passed by Sri. Chandra Prakash Asthana, Principal Judge, Family Court, Ranchi in Original Suit (MTS) No. 307 of 2010, by which the suit preferred by the appellant for dissolution of marriage with the respondent has been dismissed.

During pendency of this first appeal the matter appears to have been settled between the parties. A supplementary affidavit incorporating the terms and conditions arrived at between the parties has been mentioned. It has been jointly submitted that the suit for dissolution of marriage in terms of Section 13 B of the Hindu Marriage Act shall be filed on or before 27thy July 2023. He further submits that so far as first instalment of Rs.50,000/- is concerned the same has already been paid by the appellant.

Both the learned counsels for the respective parties submitted that the appellant as well as respondent shall strictly adhere to the terms and conditions as mentioned in the interlocutory application.

In view of the aforesaid facts and submissions, this appeal stands disposed of with a direction to court below to act in accordance with law once a suit in terms of Section 13 B of Hindu Marriage Act is preferred before it.
