Heard Mr. Ajay Kumar Pathak, learned counsel for the petitioner, Mr. Om Prakash, learned counsel for the O.P. No.2 and learned Spl.PP for the State is present.

Perused the report sent by Sri Nirmal Kumar Bharti, learned Principal Magistrate, J.J. Board, Pakur vide Letter no.32/2023 dated 08.06.2023. It has been informed by learned Principal Magistrate, J.J. Board, Pakur that Sukur Sheikh i.e. O.P. No.2 has been found guilty and he is accordingly awarded three years punishment for his reform at Special Home.

In view of the above circumstance, learned counsel for the petitioner seeks permission to withdraw this Cr. Revision No.797 of 2018 with liberty to move before the appropriate forum in accordance with law.

No objection has been raised by learned counsel for the O.P. No.2 as also by the learned APP for the State.

Thus, this Cr. Revision No.797 of 2018 is dismissed as having become infructuous with liberty to the petitioner to move before the appropriate forum in accordance with law.
