After some argument, learned counsel for the petitioners has sought for leave of this Court to withdraw the instant petition so as to raise all the available legal/factual aspects at the time of framing of charge.
Mr. Prabhu Dayal Agrawal, learned Additional Public Prosecutor appearing for the opposite party-State is having no objection to such submission of the learned counsel for the petitioners.
Considering the same, the instant criminal misc. petition is dismissed as withdrawn. However, it is left open upon the petitioners to raise all the available legal/factual aspects at the time of framing of charge for its consideration by the concerned court.
Accordingly, the instant criminal misc. petition stands disposed of.
