Learned counsel for the petitioners submits that he does not press this criminal miscellaneous petition in respect of petitioner no. 2- Mahendra Prasad, Petitioner no. 3- Sudhir Kumar and petitioner no. 4 - Rajesh Kumar Ray @ Rajesh Ray.

Accordingly, this criminal miscellaneous petition in respect of petitioner no. 2- Mahendra Prasad, Petitioner no. 3- Sudhir Kumar and petitioner no. 4 - Rajesh Kumar Ray @ Rajesh Ray stands rejected as not pressed.

This criminal miscellaneous petition has been filed under section 482 Cr.P.C with a prayer for modification of the order dated 09.08.2021 passed in ABA No. 5184 of 2021.

It is submitted by the learned counsel for the petitioner no. 1 that vide order dated 09.08.2021 passed in ABA No. 5184 of 2021, the petitioner no. 1 was directed to surrender before the court below within six weeks and deposit Rs. 10,000/- as cash security but because of paucity of money, the petitioner could not arrange money and hence he could not surrender within the stipulated time but in the meanwhile, the petitioner has arranged money and deposited the same and the copy of which is kept at page 3 of the supplementary affidavit of the brief.

Learned counsel for the petitioners submits that the time to surrender before the court below in terms of the order 09.08.2021 passed in ABA No. 5184 of 2021 be extended for six weeks from the date of this order.

Considering the facts of the case and the submission of the learned counsel for the petitioner no. 1, the prayer for extension of time is allowed with respect to the petitioner no. 1 only to surrender in the court below in terms of the order dated 09.08.2021 passed in ABA No. 5184 of 2021. Hence, the petitioners no. 1 is directed to surrender before the court below “within six weeks from the date of this order in terms of the order dated 09.08.2021 passed in ABA No. 5184 of 2021”.

The order dated 09.08.2021 passed in ABA No. 5184 of 2021 is modified to the aforesaid extent only. This criminal miscellaneous petition is disposed of accordingly.
