This Cr.M.P. has been filed for modification of the order dated

17.03.2021 passed in W.P. (Cr.) No.130 of 2018.

Learned counsel for the petitioner submits that the petitioner has not been able to procure document etc. in view of COVID-19 pandemic and that is why, he has not been able to approach the authority concerned within a period of 30 days, as directed in the said order. He further submits that one more opportunity may kindly be provided to the petitioner to approach the authority concerned and the period of approach may kindly be extended for further 30 days from today.

Mr. Sachin Kumar, learned A.A.G.-II appearing for the State submits that time was already provided and he has not complied the order and in that view of the matter, this petition is fit to be rejected.

In view of the above facts and submissions of the learned counsel for the parties, the Court has gone through the order dated 17.03.2021 and finds that the contention was raised that without hearing the petitioner, final order was passed under Section 133 Cr.P.C. and in that view of the matter, the petitioner was directed to approach the authority concerned and considering that reason for not approaching the authority concerned, the Court comes to the conclusion that in the interest of justice, it is desired

that further period of 30 days from today be extended to approach the authority concerned. Accordingly, the order dated 17.03.2021 is modified to the extent that the petitioner shall approach the authority concerned within 30 days from today.

Accordingly, this petition stands disposed of.
