Heard both the counsels.

The petitioner is an accused in a case registered under section 379 of the Indian Penal Code.

Learned counsel for petitioner has submitted the petitioner is not named in the FIR. It is submitted that the name of the petitioner has surfaced only on the statement of the co-accused namely Mobin Ansari. It is further submitted that prior to the present case one more case in connection with Ratu P. S. Case No. 70 of 2019 for the offences under other including Sections 147/148/149/323/337/338/427/504/353 in which the petitioner is on bail apart from which, he has no other criminal antecedent. Therefore, the petitioner may be granted privilege of anticipatory bail.

The learned counsel for the State has opposed the anticipatory bail application of the petitioner.

Having heard counsels for both the side; having gone through the records of the case and in the facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner and accordingly, the petitioner, above named, is directed to surrender in the court below within six weeks from today and in the event of his arrest or surrender the court below shall enlarge the above-named petitioner on bail on furnishing bail bond of Rs. 25,000/-(Rs. Twenty Five Thousand only), with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ranchi in connection with Ratu P.S. Case No. 165 of 2023, subject to the condition as laid down under section 438(2) of the Cr.P.C., with further condition that the petitioner shall report to the concerned police station on every last Saturday of the month, between 01:00 and 05:00 p.m for one year, failing which or if any adverse remarks regarding his non-appearance at the police station, his bail bond shall be liable to be cancelled. Any exemption to such attendance

shall be done so after direction of the learned Court below and the petitioner shall remain present on each and every date of trial before the Court below unless dispensed with by the learned Court below with further condition that the petitioner will submit self-attested photocopy of his Aadhaar Card and also submit his mobile number before the learned court below which he will always keep active and will not change it during pendency of this case without prior permission of the court.
