7/ 06.11.2023 Heard respective learned counsel for the petitioners and respective learned A.P.P. for the State.

Petitioners apprehend their arrest in connection with Daily Market Police Station Case No.24 of 2018, for allegedly committing offences under Sections 147, 148, 149, 341, 323, 333, 353, 379, 427, 504 of the Indian Penal Code, pending in the Court of the Judicial Magistrate First Class, Ranchi.

Petitioners submit that they are already cooperating with the investigation. This fact has also been admitted by the learned A.P.P. Learned A.P.P. submit that because of interim protection, chargesheet is not being submitted though there are sufficient materials to submit chargesheet.

If there are sufficient materials to submit chargesheet and the petitioners have got their statements recorded, I see no impediment in filing the chargesheet.

Further, since the petitioners have cooperated with the trial and as per the submission of the learned A.P.P., it gives an impression that it is not necessary to take the petitioners in custody.

Considering the aforesaid submissions and the facts of this case, I am inclined to grant privilege of anticipatory bail to the petitioners. Accordingly, the petitioners, namely, Md. Gulfam (A.B.A. No.6888 of 2023) and Md. Fardin Ahmad @ Jimmy @ Fardeen Ahmad (A.B.A. No.5442 of 2023) are directed to surrender before the Court below within four weeks from today and on their surrender/arrest, they will be enlarged on bail, on furnishing bail bonds of

Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Judicial Magistrate First Class at Ranchi in connection with Daily Market Police Station Case No.24 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and with a further condition that till charge is framed against the petitioners, if at all chargesheet is filed against them, the petitioners will appear and mark their attendance before the Officer-in-Charge, Daily Market Police Station, Ranchi once in two weeks and will cooperate with the investigation, failing which it will be open to the Officer-in-Charge concerned to take all steps for arrest of the petitioners.
