10/16.10.2023: Heard both the counsels.
The petitioner is an accused in this case for the offence registered under section 392 of the Indian Penal Code.
The learned counsel for the petitioner has submitted that only on suspicion and self-confession, the petitioner has been implicated in this case. The learned counsel for the petitioner has further submitted that recovery from the possession of the petitioner is also doubtful. No looted amount has been recovered which has been shown in the FIR. The police has shown motorcycle used in crime is also doubtful. The learned counsel has further submitted that the co-accused, namely, Faguwa Mirdha in BA No. 6598 of 2023 has been granted bail by this Court vide order dated 14.08.2023, therefore, he seeks parity. The learned counsel has further submitted that apart from this case, the petitioner has no other criminal antecedent. Moreover, the petitioner is in custody since 07.04.2023. Therefore, the petitioner may be granted privilege of bail.
