Heard learned counsel for the parties.
The petitioner named above has been made accused in connection with Deoghar (Cyber) P.S. Case No. 15 of 2023 for the offence under Sections 419, 420, 467, 468, 471, 120B of the Indian Penal Code and Sections 66(B), (C), (D), 84(C) of I.T Act, pending in the court of Addl. Sessions Judge-II-Special Judge, Cyber Crime, Deoghar.
As per the prosecution case, the police conducted raid on receiving information regarding racket involved in cybercrime in which this petitioner was apprehended and three mobile sets were seized from him. One mobile was in the name of the father of the petitioner and one of the SIMS was issued in the name of third party.
It is submitted by learned counsel for the petitioner that the mobile was not used in any cybercrime as the police has failed to trace any victim of the offence by using of mobile and SIM cards.
Learned counsel for the State has opposed the prayer for bail but has not disputed the factual assertion that during investigation, no victim has been traced to be connected with the mobiles that has been seized from the petitioner.
Considering the facts and circumstances of the case, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.25,000/(Rupees Twenty Five Thousand) with two sureties of the like amount each, to the satisfaction of learned Court below.
