Heard both the sides.
The petitioner- Amerjeet Kumar @ Amarjeet Kumar is in custody in connection with Madhupur P.S. Case No. 62 of 2023 for the offence registered under Sections 379, 411, 34 of the I.P.C. pending in the Court of learned Additional Chief Judicial Magistrate, Madhupur.
As per the prosecution case, the informant was having plant for grinding gram for production of flour. On 18.03.2023, the petitioner who is said to be the operator of the said plant, was caught red handed committing theft of 32 bags of gram.
It is submitted by the learned counsel on behalf of petitioner that he is in custody since 19.03.2023 and has been falsely implicated in the case.
Learned A.P.P. assisted by learned counsel on behalf of informant have vehemently opposed the prayer for bail. It is submitted that the petitioner has been caught red handed while committing theft.
Under the circumstances, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
