03/11.04.2023 The applicants who are in custody since 07.11.2022 have approached this Court for grant of regular bail in connection with Chatra Sadar P.S. Case No.344/2022, registered for the offence under Sections 304B/34 of IPC.
It appears that the applicant No.1 is elder brother of the husband of the deceased and applicant No.2 is mother-in-law of the deceased.
It has been submitted by learned counsel for the applicant(s) that complete set of F.I.R. alongwith its enclosure have been annexed with this bail application and there is no suppression on his/her part .
Innocence has been claimed and undertaking has been given for participation in the trial. It has been submitted by learned counsel for the applicants that they were residing separately and there is no allegation of demand of dowry against these applicants. On above basis, prayer for bail has been made.
Learned A.P.P. has opposed the prayer for bail of the applicants and submitted that the death is suicidal and all the ingredients of Section 304B of IPC are present as there is allegation of demand of dowry and harassment.
Considering the materials available on record, I am not inclined to enlarge the applicants on bail, at this stage. Accordingly prayer for bail of the applicants stand rejected.
