The Learned counsel for the petitioners submits that the allegation against the petitioners is that the informant along with two partners entered into an agreement in respect of land with the petitioners and a sum of Rs.10,00,000/- was transferred to the account of the petitioner no.1 and Rs.3,50,000/- each was transferred to the account of the petitioner nos.2, 3, & 4. It is further submitted that the allegations against the petitioners are all false. It is then submitted that the dispute between the parties is at best a civil dispute. It is further submitted that there is no allegation of any dishonest misappropriation of the property entrusted to the petitioners nor there is any allegation against the petitioners of having any dishonest intention at the time of transaction between the parties. It is next submitted that the petitioner no.1 undertakes to deposit a demand draft Rs.10,00,000/- and the petitioner nos. 2, 3 & 4 undertakes to deposit a demand draft of Rs.3,50,000/- each drawn in favour of the Registrar, Civil Court, Dhanbad without prejudice to their defence in this case, subject to final decision of the case and to that effect, the petitioners have already filed a supplementary affidavit and also undertakes to cooperate with the investigation of the case. Hence, it is submitted that the petitioners be given the privilege of anticipatory bail.
