Heard the parties.
The petitioner is apprehending her arrest in connection with Giridih (M) P.S. Case No. 177 of 2022, for the offences under Sections 306/34 of the Indian Penal Code, pending in the Court of learned Sub-Divisional Judicial Magistrate, Giridih.
Petitioner and the accused persons had gone to the house of the informant and asked her brother to delete obscene photographs of Poonam Kumari, which he had made viral on social media. They had threatened that they will institute criminal case against him. Subsequently, the brother of the informant committed suicide.
It was submitted that co-accused Punam Kumari @ Poonam Kumari has been granted anticipatory bail by this Court in A.B.A. No.1731/2023 and the case of the petitioner stands on similar footing.
Considering the aforesaid fact; I am inclined to extend the privilege of anticipatory bail to the petitioner. She is directed to surrender before the court below within two weeks from the date of receipt of a copy of this order and the learned court below on her surrender shall release her on bail on furnishing bail bond of Rs.25,000/-(Rupees Twenty Five Thousand) with two sureties of the like amount each, to the satisfaction of learned Sub-Divisional Judicial Magistrate, Giridih, in connection with Giridih (M) P.S. Case No. 177 of 2022, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
