Heard both the sides.
The petitioner- Niranjan Goud @ Niranjan Gour is in custody since 04.01.2023 in connection with Sakchi P.S. Case No. 214 of 2022 for the offence registered under Sections 380, 453 of the I.P.C. pending in the Court of Chief Judicial Magistrate, Jamshedpur.
As per the prosecution case, the matter involves house burglary in which cash and house-hold articles as well as valuable to the tune of Rupees Forty Lakhs was stolen. On disclosure statement, cash of Rs.10,000/- and one motorcycle and Santro car which are said to have been purchased from the crime proceed was seized.
It is submitted by the learned counsel on behalf of petitioner that the car had been purchased long before in 2008 much before the incidence which falsifies the case of the prosecution.
Learned A.P.P. opposed the prayer for bail. It is submitted that stolen articles and cash has been seized and he has criminal antecedent to be involved in four cases.
Considering the facts and circumstances of the case, the prayer for bail of the petitioner, is hereby, rejected.
