03/ 19.06.2023 . Petitioner above-named who is in custody since 16.10.2022 has moved this Court for grant of regular bail in connection with Garhwa P.S. Case No.559 of 2022 registered under Section 302 of the Indian Penal Code.

Heard the parties.

It is submitted by learned counsel for the petitioner that it is a case of accidental fall from the staircase resulting in the death of the deceased and the same has come in the deposition of the informant (P.W.2) who is none other than the father of the deceased. The deceased was an alcoholic and used to have frequent altercation with his wife and on the date of incidence, he fell down from the staircase resulting in his death and the same has been stated by his wife (Renu Devi) as P.W.1.

Learned APP for the State has vehemently opposed the prayer. It is submitted that it has come in the post-mortem report that there was extensive ante-mortem injuries sustained by the deceased which cannot logically be caused by falling from the staircase. The weapon of offence i.e. lathi has also been recovered.

Considering the submissions of learned counsel and the fact as discussed above, the bail application is allowed. Accordingly, the petitioner named above shall be released on bail on furnishing bail bond of Rs.25,000/(Rupees Twenty Five Thousand ) with two sureties of the like amount each to the satisfaction of learned Court below subject to the condition that one of the bailor(s) must be close relatives of the petitioner .
