Considering the submissions of the counsels and the fact as discussed above, this Court is of the considered view that the provisional bail granted to the petitioner vide order dated 24.04.2023 be confirmed till disposal of the case by the learned trial court upon the petitioner furnishing an undertaking that the petitioner will keep and maintain the opposite party no.2 with full dignity and honour as his lawful wife and will take her as and when the quarter is allotted by the BCCL to the petitioner and further undertakes to make an entry in the service book with his employer-BCCL to the effect that the opposite party no.2 is the wife of the petitioner and the petitioner will continue to pay maintenance of Rs.10,000/- per month as ordered in Original Maintenance Case No. 83 of 2022 in the Family Court, Bokaro, within six weeks from the date of this order, failing which, the provisional bail granted to the petitioner vide order dated 24.04.2023 shall stand cancelled and the learned trial court will take all coercive steps to take the petitioner into custody for facing the trial subject to the conditions laid down under section 438 (2) Cr. P.C.
