Heard the parties.

The petitioner is apprehending his arrest in connection with Saraiyahat P.S. Case No. 79 of 2015, corresponding to G.R No.663 of 2015, for the offences under Sections 409/34 of the Indian Penal Code, pending in the Court of Smt. Paridhi Sharma, learned Judicial Magistrate, 1^st class, Dumka.

On 20.05.2015 at about 10:00 A.M, one Sanjay Yadav was apprehended by local persons, while transporting 20 bags of cement. He confessed that he had purchased the seized cement from this petitioner.

Case diary, earlier called for, has been received. Perused the same.

Independent witnesses in the case diary have stated that there was previous enmity between Gopal Yadav, the brother of Sanjay Yadav and this petitioner, due to which, he has been falsely implicated in this case.

Considering the aforesaid fact; I am inclined to extend the privilege of anticipatory bail to the petitioner. He is directed to surrender before the court below within two weeks from the date of receipt of a copy of this order and the learned court below on his surrender shall release him on bail on furnishing bail bond of Rs.25,000/-(Rupees Twenty Five Thousand) with two sureties of the like amount each, to the satisfaction of Smt. Paridhi Sharma, learned Judicial Magistrate, 1^st class, Dumka, or her successor, in connection with Saraiyahat P.S. Case No. 79 of 2015, corresponding to G.R No.663 of 2015, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
