Petitioner is apprehending his arrest in connection with Borio (J) P.S. Case No. 299/2022 for the offences registered under sections 379 of the Indian Penal Code and section 04/54 of J.M.M.C.R, pending in the court of learned Chief Judicial Magistrate, Sahibganj.

Petitioner is the lease holder of the land on which illegal quarry was found to be done even after expiry of its lease. 4. Learned counsel for the petitioner has filed a supplementary affidavit bringing on record the documents which shows that after expiry of the lease, petitioner had surrendered the land to the District Mining Officer, Sahibganj on 26.06.2016. It further appears that the petitioner has responded to the notice issued under section 41(A) of Code of Criminal Procedure by filing reply to the Investigating Officer.

Considering the aforesaid facts, I am inclined to extend the privilege of anticipatory bail to the petitioner. Accordingly, petitioner, above named, is directed to surrender before the learned court below within two weeks from the date of receipt of a copy of this order and the learned court below on his surrender, shall release him on bail on furnishing bail bonds of Rs. 25,000/(Rupees twenty five thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Sahibganj in connection with Borio (J) P.S. Case No. 299/2022, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
