03/ 13.10.2023 This petition has been filed for a direction to release the deposited statutory amount in favour of the appellant/petitioner as per order dated 04.12.2018, passed in M.A. No. 41 of 2016.

M.A. No. 41 of 2016 was disposed of on 04.12.2018, which reads as under:-

“ 1. Learned counsel on instruction of the appellant has submitted that the matter has been amicably settled by the parties outside the Court and does not want to pursue the present appeal.

2. Heard. In view of the submissions of the counsel for the appellant, this appeal is, hereby, disposed off, as not pressed.

¶12

3. The deposited statutory amount shall be refunded to the appellant by the Registry, on proper identification.”

Learned counsel appearing for the petitioner submits that the said M.A. was conducted by Mr. Uday Kant Thakur, Advocate, who has left for his heavenly abode and thereafter the appellant requested the office of this court to release the said deposited statutory amount, however, the same was not released, as nobody has identified the petitioner / appellant.

In view of the above submissions, it appears that the identification of the petitioner / appellant is required in the matter. Accordingly, the statutory amount deposited in M.A. No. 41 of 2016 shall be remitted back to the learned court, who had passed the award.

The appellant shall file the proper petition before the learned court, who after proper verification, release the said amount in favour of the petitioner / appellant.

This petition is allowed and disposed of.
