Heard both the sides.
The petitioner- Gulab Chand Mahato @ Gulab Chand Mahto is in custody since 08.12.2022 in connection with Mahuda (Bhatdih O.P.) P.S. Case No. 64 of 2022 for the offence registered under Sections 376, 506 of the I.P.C. pending in the Court of learned J.M. 1st Class, Dhanbad.
It is submitted by the learned counsel on behalf of petitioner that the prosecutrix is married major lady aged 28 years and the alleged incidence of rape was committed in 2020 in a hotel but the present case has been filed on 25.07.2022. It is submitted that it was consensual physical relationship and the case was reported only when it came to knowledge of her husband.
Learned A.P.P. opposed the prayer for bail.
Under the circumstances, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
