The instant appeal has been preferred challenging the order passed in M.A.C.T Case No. 91 of 2014 dated 30.11.2016 whereby and whereunder, a sum of Rs.17,49,000/- has been directed to be paid.

On deliberation, Mr. Ashutosh Anand, learned counsel for the appellant- M/s Cholamandalam MS General Insurance Co. Ltd. as also Mr. Arvind Kumar Lal, learned counsel for the respondents have agreed for final settlement of the dispute by making payment of lump-sum amount to the tune of Rs.13,70,000/-, over and above, the amount already paid, in favour of the respondents.

In view thereof and as per the agreement arrived at in between the parties, the instant appeal is being finally disposed of with a direction upon the appellant- M/s Cholamandalam M.S. General Insurance Co. Ltd. to make payment of lump-sum amount of Rs.13,70,000/-, over and above the amount already paid, in favour of the respondents within the period of two months’ from the date of receipt of copy of the order in the following manner:-

(i) The claimant will open a Bank A/c and furnish the A/c number to the concerned Tribunal preferably within 10 days, if not already opened and furnished.

(ii) The concerned Insurance Company will deposit the agreed amount, in the A/c of the concerned tribunal through RTGS/NEFT within the period as stipulated hereinabove.

(iii) The concerned Tribunal shall disburse the aforesaid amount as agreed, to the respective accounts of the claimants, forthwith.

In view thereof, the instant appeal stands disposed of.

So far as statutory amount which has been deposited by the learned counsel for the appellant at the time of filing of the appeal is concerned, the Registrar General of this Court is directed to refund the same in favour of the appellant within a period of eight weeks on proper identification.
