The judgment dated 25th August 2018 passed in Original Suit No.90 of 2017 (in short, custody suit) has been challenged by Unnati Devi and her two children who were born out of the wedlock of Unnati Devi with Nirmal Mandal.
“8. Having regard to above facts and circumstances and material, available on record as well as evidences on behalf of petitioner it is crystal clear that Petitioner should be custodian as a guardian of Gunjita Kumari and Aniket Kumar Mandal for their bright future. Accordingly, Nirmal Mandal S/o Nityanand Mandal is the custodian of Gunjita Kumari and Aniket Kumar Mandal. Hence, the petition filed on behalf of the Nirmal Mandal for guardianship of Gunjita Kumari and Aniket Kumar Mandal (minor children) is hereby allowed from the date of order and issue framed in this case is also decided in favour of the petitioner.”
