This criminal miscellaneous petition has been filed at the instance of the petitioner for restoration of A.B.A. No. 5158 of 2021 to its original file.
Learned counsel for the petitioner submits that the A.B.A. No. A.B.A. No. 5158 of 2021 was rejected as not pressed vide order dated 09.08.2021. Learned counsel for the petitioner submits that due to inadvertence, he could not appear when the case was called out, which resulted in dismissal of ABA No. 5158 of 2021. It is further submitted that the petitioner has very good grounds to agitate in this case and unless the same is restored to its original file, the petitioner will be highly prejudiced. Hence, it is submitted that A.B.A. No. 5158 of 2021 be restored to its original file.
Learned Addl. P.P. has no serious objection for the prayer of restoration of anticipatory bail application.
Considering the aforesaid submission of the learned counsel for the petitioner, A.B.A. No. 5158 of 2021is restored to its original file to the stage, it was before its dismissal.
List A.B.A. No. 5158 of 2021after a week.
This criminal miscellaneous petition is disposed of accordingly.
