Heard the parties through video conferencing.
This criminal miscellaneous petition has been filed at the instance of the petitioner for restoration of A.B.A. No. 9866 of 2021 to its original file.
Learned counsel for the petitioner submits that A.B.A. No. 9866 of 2021 was dismissed for default as the petitioner could not appear when the case was called out. It is submitted that due to some technical problem, the learned counsel for the petitioner could not connect to this Court through video conferencing and because of the same; he could not appear when the case was called out. It is then submitted that the petitioner has very good grounds to agitate in this anticipatory bail application and unless A.B.A. No. 9866 of 2021 is restored to its original file, the petitioner will be highly prejudiced. Hence, it is submitted that the A.B.A. No. 9866 of 2021 be restored to its original file.
Learned Addl. P.P. has no serious objection to the prayer for restoration.
Considering the aforesaid submission of the learned counsel for the petitioner, A.B.A. No. 9866 of 2021 is restored to its original file to the stage, at which, it was before its dismissal.
List A.B.A. No. 9866 of 2021 under the appropriate heading after one week.
