view of the guidelines of the High Court taking into account the situation arising due to COVID-19 pandemic.

Mr. Ranjan Kumar Singh, learned counsel appearing for the petitioners submits that some of accused persons have been tried in the Court below and they have been acquitted, as the witnesses and informant have not supported the case on the point of assault. He further submits that there is a compromise between the petitioners and the O.P. No. 2, which has been supported by Mr. Anand Kumar Sinha, learned counsel, who has appeared suo motu on behalf of O.P. No. 2.

In the present petition, the FIR and the cognizance order of the year 2017 has been challenged in the year 2022 itself. The Court is not inclined to quash the entire criminal proceedings.

At this stage, learned counsel appearing for the petitioners seeks permission to withdraw this criminal miscellaneous petition with the liberty to take all the grounds at the appropriate stage.

This criminal miscellaneous petition is permitted to be withdrawn and disposed of with the aforesaid liberty.
