Ms. Shail Lakra, the learned counsel for the petitioner is seeking adjournment on the ground of unavailability of Mrs. Ritu Kumar, the learned arguing counsel.

We are not inclined to adjourn hearing of this contempt case for the reason that an affidavit dated 11^th May 2022 has been filed on behalf of the contemnor in which a categorical statement has been made that the order passed by the Hon'ble Division Bench in LPA No. 40 of 2018 has been complied with.

Ms. Shail Lakra, the learned counsel for the petitioner referring to the supplementary affidavit dated 10^th May 2022 submits that the respondent-State of Jharkhand instead of extending consequential benefits on account of re-designation of the post of Senior Personal Assistant to Private

Secretary has reduced the pay scale of the petitioner.

In view of the averments made in the affidavit dated 11^th May 2022, we are not inclined to proceed further with this contempt case for the reason that even part compliance of an order by the contemnor is considered sufficient to drop the contempt proceeding – a contempt Court is no doubt not an executing Court.

We are of the view that the grievance raised by the petitioner on account of reduction of pay scale or as stated by Ms. Shail Lakra, the learned counsel for the petitioner, that consequential benefits on re-designation of the post have not been given to the petitioner are the matters which cannot be agitated in the present contempt case, rather remedy for the petitioner lies elsewhere – may be filing afresh writ petition. 6. Cont. Case (Civil) No. 987 of 2019 is closed.
