the State.
Learned counsel for the applicant undertakes to remove the defects, as pointed out by the office within a period of one week.
This bail application has been filed on behalf of the applicant– Parvez Alam Ansari with prayer to release on bail in connection with Azadnagar P.S. Case No.44 of 2021 registered under Sections 376/420 of the Indian Penal Code pending in the court of learned Judicial Magistrate, 1st Class, Jamshedpur.
Learned counsel for the applicant has submitted that the F.I.R. of this case was lodged by the victim herself with the allegations that the applicant has committed rape upon her on the pretext of solemnizing marriage. It is further submitted that the applicant and the informant both are married and the informant was doing job at the shop of the applicant. It is also alleged that on account of physical relations between them, the informant also became pregnant. The informant is 32 years old lady and she was already married and the allegations made against the applicant are false and concocted. The applicant has been languishing in jail since 29.05.2021.
Learned A.P.P. appearing on behalf of the State vehemently opposed the contentions made by the learned counsel for the applicant and contended that the F.I.R. of this case was lodged by the victim herself and she has supported the prosecution story.
In view of the submissions made and material on record, the bail application of the applicant is hereby allowed. Let the applicant be released on bail on furnishing bail bond of Rs.25,000/-(Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of the court of learned Judicial Magistrate, 1st Class, Jamshedpur in aforesaid case.
