The anticipatory bail application filed on behalf of petitioners, who are apprehending their arrest in connection with Ranga P.S. Case No. 71 of 2022 for the offence registered under Sections 175, 379, 414 of the Indian Penal Code, Sections 21A/21(6)/22 of Mines and Minerals (Development and Regulation Act), 1957, Rules 4/54 of Jharkhand Minor Mineral Concession Rules, 2004 and Rule 7/9 of Jharkhand Minor Mineral (Prevention of Illegal Mining) Transportation and Storage Rule, 2017 pending in the Court of learned Additional Chief Judicial Magistrate, Rajmahal, is pressed into motion.

It is submitted by the learned counsel on behalf of the petitioners that petitioner No.1 is driver and petitioner No.2 is owner and 150 cft of sand was seized from the tractor. It is further submitted that there is no criminal antecedent of the petitioners.

Learned A.P.P. has opposed the prayer for bail.

Considering the submissions made, the anticipatory bail application is allowed. Accordingly, the petitioners, above named, are directed to surrender before the learned Trial Court within a period of two weeks and in the event of their arrest or surrender, they shall be released on bail on furnishing bail bond of Rs.25,000/(Rupees Twenty Five Thousand only) each with two sureties of the like amount each to the satisfaction of the Court below, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and the petitioners will deposit Rs.5000/- each in the Court below as security amount.

The petitioners will co-operate in the investigation and will appear under Section 41A Cr.P.C. as and when required and comply with the condition as laid down under Section 438(2) of the Cr.P.C.
