06/ 23.11.2022 Heard learned counsel for the applicant and learned A.P.P. for the State.
This bail application has been filed on behalf of the applicant–Sourav Bagh with prayer to release on bail in connection with Sidhgora P.S. Case No. 153 of 2021, registered under Section 392 of the Indian Penal Code, pending in the court of the Judicial Magistrate, 1st Class, Jamshedpur.
Learned counsel for the applicant has submitted that the F.I.R. of this case was lodged by the informant in regard to snatching away her gold chain and locket by two unknown persons who had come by the bike.
Learned Counsel for the applicant has submitted that his name transpired during investigation in confessional statement of co-accused Aman Mandal and Navin Kumar and it is also alleged that one Jagjit Singh whose statement was also recorded under Section 164 Cr.P.C. had alleged that the said chain was sold to him by present applicant. Indeed, the applicant had not sold the said chain to Jagjit Singh. As per F.I.R. allegation, there were two unknown persons and the name of the applicant transpired in confessional statement of those two persons who were Aman Mandal and Navin Kumar. The applicant has been languishing in Jail since 20.10.21.
Learned A.P.P. appearing on behalf of the State vehemently opposed the contentions made by the learned counsel for the applicant.
In view of the submissions made and materials on record, the bail application of the applicant is hereby allowed. Let the applicant be released on bail on furnishing bail bond of Rs.25,000/-(Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of the court concerned in aforesaid case.
