Heard learned counsel for the parties.
The petitioner has been made an accused in connection with Dhurwa P.S. Case No. 08 of 2022, registered for the offence under Section 420, 467, 468, 120B of the Indian Penal Code and Section 17 of C.L.(A) Act, pending in the court of learned Chief Judicial Magistrate, Ranchi.
Learned counsel for the petitioner has submitted that the informant— police officer had received a secret information that one Nivesh Kumar, who was working for PLFI, was going to supply SIM cards and other essential articles. Accordingly, raid was conducted and two persons were apprehended at the spot, who were identified as Amirchand Kumar and Arya Kumar Singh. It is further alleged that co-accused Arya Kumar Singh disclosed that he had received the sim cards from one Ujjawal Kumar Sahu and used to give the same to Nivesh Kumar and Amirchand Kumar.
Learned counsel for the petitioner has submitted that petitioner is innocent and has committed no offence at all rather his name has surfaced on the basis of confessional statement of co-accused. It is further
submitted that co-accused Amirchand Kumar in B.A. No. 5172 of 2022 vide order dated 15.06.2022; Ujjawal Kumar Sahu in B.A. No. 4751 of 2022 vide order dated 08.06.2022 have been granted bail by the same bench of this Court and other co-accused, namely, Shubham Kumar Poddar in B.A. No. 4930 of 2022 vide order dated 23.06.2022; Arya Kumar Singh in B.A. No. 3898 of 2022 vide order dated 22.04.2022; Nivesh Kumar in B.A. No. 5239 of 2022 vide order dated 21.07.2022 have been granted bail by the Co-ordinate Bench of this Court. The petitioner is languishing in Judicial custody since 13.01.2022 without rhymes and reasons. Petitioner undertakes to co-operate in the trial of the case by remaining physically present as and when required and shall not indulge in any manner in tampering with the prosecution evidences or influencing the witnesses of prosecution, hence, the petitioner may be enlarged on bail.
Learned A.P.P appearing on behalf of State has opposed the prayer for bail of the petitioner and submitted that there are sufficient materials against the petitioner showing his involvement in the present case, hence he does not deserve bail.
Regard being had to the facts and circumstances of the case and nature of allegation against the petitioner coupled with materials available against petitioner, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing of bail bond of Rs. 20,000/-(Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Ranchi in connection with Dhurwa P.S. Case No. 08 of 2022 subject to the conditions:-
In case of violation of the aforesaid condition the bail of the petitioner shall be cancelled and shall be taken into custody by the learned trial court itself, for the purpose of trial.
