The anticipatory bail application filed on behalf of petitioner, who is apprehending his arrest in connection with C.P. Case No. 501 of 2018 for the offence registered under Section 306 of the Indian Penal Code pending in the Court of Ms. Sandhya Prasad, learned Judicial Magistrate 1^st Class-cum- Prob. Civil Judge (Jr. Div.), Bokaro, is pressed into motion.

It is submitted by the learned counsel on behalf of the petitioner that earlier case was filed against this petitioner under Section 304B of the I.P.C., who is husband of the deceased and after investigation, police submitted final form as mistake of fact. On the basis of protest petition, subsequently cognizance has been taken under Section 306 of the I.P.C. but there is no material to make out an offence under abetment to commit suicide. The parties have also arrived at out of Court settlement.

Learned A.P.P. has opposed the prayer for bail.

Considering the submissions made, the anticipatory bail application is allowed. Accordingly, the petitioner, above named, is directed to surrender before the learned Trial Court within a period of two weeks and in the event of his arrest or surrender, he shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties of the like amount each to the satisfaction of the Court below, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
