06/ 05.08.2022 Heard learned counsel for the applicant and the learned A.P.P. for the State.
This anticipatory bail application has been filed on behalf of the abovenamed applicant seeking anticipatory bail in connection with Complaint Case No. 2732 of 2019, registered under Sections 47 (a) (f) and 55 of the Excise Act, pending in the court of the Chief Judicial Magistrate, Giridih.
Learned Counsel for the applicant has submitted that, as per offence report, during raid one Babu Ram Murmu was apprehended and from his house total sprit (Sushav)-100.000 Litre (2) Foreign Liquor- 90.000 Litre (3) Masaledar Country made Liquor-40.000 Litre (4) Role of empty pouch of Masaledar country made liquor 5 piece, (5) Empty Bottle-300 piece (6) Royal Stag whisky Wrapper-1000 piece (7) Asanjak Label1000 piece (8) Cork of Royal Stag whisky-1200 piece and (9) Cork of Imperial Blue-1000 piece were recovered and name of the applicant figured on disclosure made by the apprehended accused.
Learned Counsel for the applicant has submitted that the applicant was not apprehended at the spot. No incriminating article was recovered from the house of the applicant. The applicant is having no criminal antecedent and has been implicated in this case with the object to humiliate him on being arrested by the police.
Learned A.P.P. appearing on behalf of the State vehemently opposed the contentions made by the learned counsel for the applicant
In view of the above no useful purpose would be served in keeping the present application pending or calling for counter affidavit from the State. Without expressing any opinion on the merits of the case, the applicant is entitled to be released on anticipatory bail, at this stage. Accordingly, prayer for anticipatory bail of the applicant is hereby allowed.
In the event of arrest, let the applicant be released on anticipatory bail on furnishing bail bond of Rs.20,000/-(Rupees Twenty Thousand) with two sureties of the like amount to the satisfaction of the court concerned on the following conditions :-
