3/06.05.2022 Heard learned counsel for the applicant and learned APP for the State.

The bail application has been filed on behalf of the abovenamed applicant with a prayer to release on bail in connection with Deoghar (cyber) P.S. Case No.02 of 2022 under sections 419,420,467,468,471 & 120B of the IPC and Sections 66(B), 66(C) 66(D) and 84(C) of the Information and Technology Act, pending in the court of learned Additional Sessions JudgeII-cum-Special Judge, Cyber Crime, Deoghar.

Learned counsel for the applicant has submitted that FIR of this case was lodged against 3 named accused persons including the applicant with these allegations that all the accused persons were involved in committing cybercrime. It is submitted that one mobile phone along with SIM card is said to be recovered from the possession of the applicant but there is nothing on record to show that the applicant had used the said mobile in committing cybercrime against any person. Similarly situated co-accused Pawan Kumar Das has been granted bail in B.A. No.2485/2022 vide order dated 20.04.2022 by this court. The applicant has been languishing in jail since 08.01.2022.

Learned APP for the State vehemently opposed the contentions made by the learned counsel for the applicant.

In view of the submissions made and the materials on record, these bail applications of the applicant is allowed. Let the applicant be released on bail on furnishing bail bond of Rs.20,000/- (Rupees twenty thousand) with two sureties of like amount to the satisfaction of the court concerned in the aforesaid case.
