2. Learned counsel for the petitioner submits that the petitioner is in judicial custody since 07.01.2019 in connection with S.T. No.186 of 2019, arising out of Deoghar Town P.S. Case No.04 of 2019, for the alleged offence under Sections 302 & 34 of the Indian Penal Code and Section 27 of the Arms Act, pending in the learned court of Additional Sessions Judge – VIII, Deoghar.

Learned counsel for the petitioner submits that the bail application of the petitioner was rejected by this Court in B.A. No.3617 of 2019 vide order dated 15.07.2019 and thereafter the petitioner had moved in B.A. No.11258 of 2019, which was dismissed vide order dated 15.05.2020 and again the petitioner had moved for grant of bail in B.A. No.11410 of 2020 which was also rejected vide order dated 25.06.2021. He submits that the petitioner has renewed his prayer for bail on account of his custody since 07.01.2019. He further submits that the petitioner is ready to abide by any condition that may be imposed by this Court.

4. Learned counsel for the State submits that a counter-affidavit has been filed stating that out of 16 prosecution witnesses, 9 have already been examined and 7 are yet to be examined. He also submits that the first I.O. of the case has expired.

After hearing the learned counsel for the parties and considering the custody of the petitioner, the petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/-(Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge – VIII, Deoghar in connection with S.T. No.186 of 2019, arising out of Deoghar Town P.S. Case No.04 of 2019, on the following conditions:

(i) the petitioner will submit self-attested copy of his Aadhar Card

along with his phone number at the time of furnishing bail bond and he will not change the phone number during the pendency of the case; (ii) the bailors of the petitioner should be father and the mother; and

¶16

(iii) the petitioner would physically attend the learned court below on each and every date and on account of his failure to attend even on one date, the bail bond furnished by the petitioner will be immediately cancelled by the learned court below.

6. The instant bail application is allowed with the aforesaid conditions.

7. Let a copy of this order be communicated to the learned court below through “FAX/email”.
