This bail application has been filed on behalf of the applicant–Arun Kumar Ray @ Arun Ray with prayer to release on bail in connection with Pakur (Town) P.S. Case No. 198 of 2021, registered under Sections 302/34 of the Indian Penal Code, pending in the court of the Chief Judicial Magistrate, Pakur.

Learned counsel for the applicant has submitted that the F.I.R. of this case was lodged by the father of deceased against two named accused with these allegations that daughter of the informant was married with Arun Kumar Ray @ Arun Ray in the year 2007. On 10.12.2021 son of the informant received information from some neighbour of the in-laws house of his daughter that the members of the in-laws house had set his daughter ablaze. On receiving that information, informant along with persons of the village reached to Pakur amid the way he received information that the daughter had been referred for higher treatment to Rampurhat Medical College where she was declared dead.

Learned Counsel for the applicant has submitted that as per F.I.R. allegations occurrence is of 10.12.2021 and the F.I.R. of this case was lodged on next day. The applicant is the husband of deceased and during 13 years old marriage after solemnization of marriage no complaint was ever made against the applicant in regard to subjecting the daughter of the informant and the applicant has been languishing in jail since 13.12.2021.

Learned A.P.P. appearing on behalf of the State vehemently opposed the contentions made by the learned counsel for the applicant and contended that the homicidal death of the daughter of the informant was committed in the matrimonial house and the applicant was present on the fateful night at the very house. The cause of death is burning, the same is also confirmed by the post-mortem report. Independent witness Sudhir Kumar Singh, Amit Kumar Singh and Poonam Devi who were neighbours of the matrimonial house of the deceased had stated that having heard her hue and cry, they

reached to the house of Arun Kumar Ray @ Arun Ray and saw Ritu Devi in burning condition. The people of the locality took her to the Hospital. On being asked from Arun Kumar Ray @ Arun Ray he told nothing in regard to the alleged occurrence and no satisfactory reply was given. In view of para 51 and 52 of the case diary witness Pinky Rajak and Rekha Devi both have stated that having heard the screaming from the house of Arun Kumar Ray @ Arun Ray, they reached there and saw Ritu Devi whose hands were tied from behind and she was burning. They put the blanket just to extinguish the fire and immediately persons of locality took her to the hospital.

In view of the submissions made and materials on record, the bail application of the applicant is hereby rejected.
