02/03.01.2022 Heard learned counsel for the applicant and learned A.P.P. for the State.

This bail application has been filed on behalf of the applicant– Falguni Rout @ Faguni Yadav @ Faguni Rout with prayer to release on bail in connection with Dumka Muffassil P.S. Case No.51 of 2021 registered under Sections 414/120-B/34 of the Indian Penal Code, Sections 3/5 of the Explosive Substance Act pending in the court of learned Chief Judicial Magistrate, Dumka.

Learned counsel for the applicant has submitted that the F.I.R. of this case was lodged against three named accused persons including the applicant and unknown persons by the police officer and all the accused persons were intercepted by the police, while they were travelling by the Tata Sumo car in which the detonators and explosive substance were kept in some sacks. It is further submitted that as per F.I.R. allegations, the applicant is alleged to have purchased the said vehicle in which the explosive substance was being carried and whole business is alleged to be conducted by the applicant. It is also submitted to the contrary as per paragraph 25 of the casediary as mentioned in the impugned order passed by the learned court below, the vehicle in question belong to Bhim Kumar Sharma, who has sold the same to one Panchanand Rout, as such, the said vehicle does not belong to the applicant. The applicant has been languishing in jail since 15^th June, 2021 having no criminal antecedent.

Learned A.P.P. appearing on behalf of the State vehemently opposed the contentions made by the learned counsel for the applicant and contended that as per F.I.R. allegations, though the vehicle belong to the applicant, yet the same is not corroborated with paragraph 25 of the case-diary.

In view of the submissions made and material on record, the bail application of the applicant is hereby allowed. Let the applicant be released on bail on furnishing bail bond of Rs.25,000/-(Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of the court of learned Chief Judicial Magistrate, Dumka in aforesaid case.
